Terms of Service

sshVM also referred to as 'the Company' in the proceeding text agrees to provide services to the subscriber also referred to as 'you' and 'the customer' in the proceeding text, subject to the following Terms of Service. By submitting your order, you acknowledge that you have thoroughly read, and agreed to abide with sshVM's TOS (Terms of Service) and AUP (Acceptable Use Policy). The TOS and AUP may be changed at any time at the discretion of the Company without advanced notice.


Content:
You may not publish any material that is grossly offensive, including, exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, or invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group.

 

Piracy, hacking, cracking, ddos, slowhoris, warez, keygen, exploitive software or text that educates or encourages this activity and/or use are not allowed.

 

Payment Policies:
sshVM will invoice 12 days in advance. First Overdue Reminder will be sent very next day of invoice due date. Second Overdue Reminder will be sent after 2nd day of due. VPS will be suspended and Late fee will be added. Third and Final Overdue Reminder will be sent on 3rd day of invoice due date. After 7 days of payment due, VPS will be terminated.

 

Cancellation Requests:
To cancel your service, you must do that from your Client Area using the request cancellation feature before the next invoice due date. You must provide all the needed information to cancel your service and all pending invoices must be paid in full before the cancellation. sshVM reserves the right to terminate a Client's account without notification if the account violates the TOS/AUP. No refund will be given.

 

Refunds and Disputes:
All payments to sshVM are non-refundable. If any billing disputes it must be reported to sshVM within 60 days in order to receive compensation.

 

Bandwidth Usage Policy:
sshVM assigns bandwidth as per the choosen VPS plan. If bandwidth limit is exceeded, VPS will be automatically suspended and will be re-activated on 1st day of a month. Please monitor your limit closely and contact our support for upgrade if necessary.

 

Backups:
sshVM do not backup Client's data. It is Client's responsibility to backup all data. sshVM is not responsible for any data loss.

 

Mail/Spam Policy:
sshVM has a zero tolerance spam policy. We do not allow unsolicited e-mail, bulk emailing, spamvertisement and spam. We pro-actively monitor SMTP port and number of connections made to mail servers. Any client’s found using services for unsolicited spam will find their services suspended / terminated immediately without refund.

 

Abuse Complaints:
sshVM will forward all complaints to you and based on impact of abuse service will be suspend or active. You will have 24-48 hours to solve any mentioned complaints or at least respond to us explaining the problem. If the client ignored our TOS/AUP violation notifications (Abuse Complaints), we reserve the right to terminate the mentioned services in the complaints with no refunds.

 

Liability:
Customer is solely responsible for the conduct of the Customers business and all other matters under Customers control. IN NO EVENT SHALL sshVM, ITS PARENT, SUBSIDIARIES, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, REPRESENTATIVES OR LICENSORS, OR ANY OTHER PARTY INVOLVED IN PRODUCING, CREATING OR DELIVERING sshVM SERVICE, TECHNOLOGY OR CONTENT, BE LIABLE TO The Client IN ANY MANNER WHATSOEVER FOR LOSS OF OR INACCURACY OF DATA, GOODS, REVENUES, PROFITS, SERVICES, OR TECHNOLOGY OR FOR ANY DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SIMILAR DAMAGES, EVEN IF sshVM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The Client HEREBY WAIVES ANY AND ALL CLAIMS AGAINST sshVM AND ITS PARENT, SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF CUSTOMERS USE OF sshVM SERVICE.
